The following
terms and conditions govern the sale by the OPTIMUM Computer
Systems, Inc. entity named on the invoice/packing slip
("OPTIMUM") that will be provided to the Customer on orders
for computer systems and/or related products sold in Puerto
Rico. By accepting delivery of the computer systems and/or
other products described on that invoice/packing slip,
Customer agrees to be bound by and accepts these terms and
conditions. THESE TERMS AND CONDITIONS APPLY (i) UNLESS THE
CUSTOMER HAS SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT WITH
OPTIMUM, IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN OR
(ii) UNLESS OTHER OPTIMUM STANDARD TERMS APPLY TO THE
TRANSACTION. These terms and conditions are subject to change
without prior written notice at any time, in OPTIMUM's sole
discretion.
Shipping charges
Prices shown do not include shipping, handling and
installation charges, if applicable. OPTIMUM will collect
from, and Customer is responsible to pay.
Payment Terms, Orders, Quotes, Interest
OPTIMUM accepts VISA, MasterCard and American Express. Terms
of payment are within Optimum's sole discretion, and, unless
otherwise agreed to by OPTIMUM, payment must be received by
OPTIMUM prior to Optimum's acceptance of an order. Orders are
not binding upon OPTIMUM until accepted by OPTIMUM. Any
quotations given by OPTIMUM will be valid for the period
stated in the quotation.
Delivery Terms
We ship promptly based on product availability. Please call
787-889-0532 for availability. You must provide a delivery
address, as we cannot ship to a P.O. Box. some rural locations
may require additional delivery time and additional charges.
Title passes upon shipment and risk of loss passes upon
delivery by our carriers. All shipments within Puerto Rico are
insured at no additional changes. OPTIMUM is not responsible
for shipping or other delays caused by events beyond our
control. Products offered by OPTIMUM are shipped as a domestic
sale to the purchaser.
Returns and Refunds
Opened software may not be returned. Defective products may be
returned within thirty (30) days of your invoice date for
repair or replacement, but not for refund. All items must be
in "as new" condition, in original packaging, and with all
warranty cards, manuals, and accessories. Any discrepancies
could result in a delay or partial forfeiture of your refund.
A restocking fee will be charged on all returned items and
returned printers with installed toner or inkjet cartridges,
all equipments need to be in original boxes or packaging.
Refunds on purchases made with a credit card will only be
credited to the same card. Items returned without prior
approval and an RMA number will be refused.
Product Availability
Limited stock available. Offers are valid while supplies last.
Prices may fluctuate; call for current pricing. Products may
not be available for immediate delivery. Accessories shown
with carrying cases are not included.
Warranties
THE LIMITED WARRANTIES APPLICABLE TO OPTIMUM-BRANDED PRODUCTS
ARE INCLUDED IN THE DOCUMENTATION ALONG WITH THE PRODUCTS.
OPTIMUM MAKES NO EXPRESS WARRANTIES EXCEPT THOSE STATED IN
THIS SECTION AND IN OPTIMUM'S APPLICABLE WARRANTY STATEMENT IN
EFFECT ON THE DATE OF YOUR INVOICE. ANY SUCH WARRANTIES WILL
BE EFFECTIVE, AND OPTIMUM WILL BE OBLIGATED TO HONOR ANY SUCH
WARRANTIES, ONLY UPON OPTIMUM'S RECEIPT OF PAYMENT IN FULL FOR
THE ITEM TO BE WARRANTED. OPTIMUM DISCLAIMS ALL OTHER
WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION
IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE. OPTIMUM'S RESPONSIBILITY FOR WARRANTY
CLAIMS IS LIMITED TO REPAIR AND REPLACEMENT AS SET FORTH IN
OPTIMUM'S APPLICABLE WARRANTY STATEMENT IN EFFECT ON THE DATE
OF THE YOUR INVOICE. OPTIMUM RESERVES THE RIGHT TO MODIFY ITS
WARRANTY AT ANY TIME, IN ITS SOLE DISCRETION. ALL SOFTWARE IS
PROVIDED SUBJECT TO THE LICENSE AGREEMENT THAT IS PART OF THE
PACKAGE. CUSTOMER AGREES TO BE BOUND BY THE LICENSE AGREEMENT
ONCE THE PACKAGE IS OPENED OR ITS SEAL IS BROKEN. OPTIMUM DOES
NOT WARRANTY ANY SOFTWARE UNDER THIS AGREEMENT. WARRANTIES, IF
ANY, FOR THE SOFTWARE ARE CONTAINED IN THE LICENSE AGREEMENT
THAT GOVERNS ITS PURCHASE AND USE. ALL OTHER PRODUCTS ARE
COVERED BY THE ORIGINAL MANUFACTURER'S LIMITED WARRANTY.
WARRANTIES, IF ANY, DO NOT COVER DAMAGE FROM EVERY DAY WEAR
AND TEAR, ABUSE OR FROM TRANSPORTATION BY A COMMON CARRIER.

Questions about a purchase from OPTIMUM should be directed to
1-787-889-0532 during the first 30 days. Specialists are
available Monday through Friday, 8a.m. to 5 p.m. Every OPTIMUM
branded product you purchase from us comes with the protection
of our Limited Warranty. For products purchased from us that
are not OPTIMUM branded, technical support is provided by the
original manufacturer, not by OPTIMUM, and service offerings
may vary from product to product.
Limitation of Liability
OPTIMUM DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET
FORTH HEREIN, INCLUDING ANY LIABILITY FOR PRODUCTS NOT BEING
AVAILABLE FOR USE OR FOR LOSS OR CORRUPTED DATA OR SOFTWARE.
OPTIMUM WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS
OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES,
EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY
CLAIM BY ANY THIRD PARTY EXCEPT AS EXPRESSLY PROVIDED HEREIN.
