Term

This warranty shall commence depending upon warranty plan purchased.

Service Provided

The services provided there under are only available for the specific equipment as indicated on the invoice. OPTIMUM Computer or its authorized service provider shall use all reasonable efforts to perform services, but will not be responsible for delays or failures in performance when due to causes beyond its reasonable control. Replacement parts will be provided by OPTIMUM Computer without charge and shall be either new or reconditioned or reassembled parts, which are equivalent to new. All replaced parts shall become the property of OPTIMUM Computer. OPTIMUM Computer or its authorized service provider reserves the right to charge customers at OPTIMUM Computer's then current rates for consumable parts or other parts required by customer such as batteries, AC adapter/charger, touch-pad, speakers, microphones, bulbs, burned pixel in LCD's and fuses. Services shall be provided during the Term from 8:00 a.m. to 5:00 p.m. Monday through Friday exclusive of statutory holidays ("Covered Hours").

Service Limitations

The following services are outside the scope of services and will, upon customer's request, be furnished by OPTIMUM Computer on an as-available basis at OPTIMUM Computer or its authorized service providers' then-current time and materials charge. (A) Software or any operating systems issues, like re-installing the OS, because replacements of motherboard, hard disk, any other part or virus in the computer, have an extra charge that is not included in the warranty and will be charged by OPTIMUM Computer or it's authorized service provider, OPTIMUM quote and inform a customer the charge before Repairs for his authorization, in the case the client does not approve the repair OPTIMUM have the responsibility to change the damage part only and the client is responsible to select other certified company to install the operating systems. (B) Replacements or adjustments or increased service time required as a result of improper installation or software setup (unless by OPTIMUM Computer). (C) Any cause external to the Equipment, including but not limited to any act of God, lightning or power surges, abuse, negligence, accident or failure to maintain the proper operating environment. (D) Modification, alterations, attachments or services made or performed by persons other than OPTIMUM Computer or its authorized service provider. (E) Use of equipment, programs, attachments or devices not approved by OPTIMUM Computer. (F) Repairs, replacements or adjustments or increased service time due to software viruses.

Warranty Limitation

THERE ARE NO OTHER WARRANTIES OR CONDITIONS RESPECTING THE EQUIPMENT, EXPRESS OR IMPLIED, IF ANY, ARE LIMITED TO THE DURATION OF THE EXPRESS WARRANTY PROVIDED HEREIN.

Customer Obligations

The customers must maintain the equipment in a good operating environment, including proper electrical supply, proper air circulation in some case need Air Condition because the place is to hot, smoke air or dirty air, in accordance with manufacturer's instructions, including external cleaning. The internal cleaning of the computer is offer by OPTIMUM for a minimum fee. The customer shall be responsible for save all the documentation, driver’s disk, operating systems disk and all license for software and operating systems include with your computer for future repairs, and all proper packaging, freight and insurance charges to OPTIMUM Computer's authorized Repair location. CUSTOMER SHALL BE SOLELY RESPONSIBLE FOR ADEQUATE BACK UP OF ALL FILES AND PROGRAMS ON A DAILY BASIS AND IF FOR ANY REASON THE CUSTOMER BROKEN THE SPECIAL WARANTY SEAL IN THE BACK OF THE COMPUTER TO OPEN, THE WARRANTY AUTOMATILY ARE VOIDED AND CANCEL ALL OBLIGATION OF OPTIMUM COMPUTER SYSTEMS, INC.

When Service Is Needed

OPTIMUM Computer will provide you with obtaining warranty service. Please call 1-787-889-0532 or fax your request to 787-889-5232 or email us at ocspr@ocspr.com. Please retain this warranty Certificate for evidence of your coverage and provide it upon request. Otherwise, extended warranty service will not be provided.

Out-Of-Scope Services

Any other services performed by OPTIMUM Computer at the Customer's request which are outside the scope of Services for any Customer shall be separately invoiced by OPTIMUM Computer or its authorized service provider. Said invoices must be prepaid prior to beginning of service.

Limitation of Liability

IN NO EVENT SHALL OPTIMUM COMPUTER OR IT'S AUTHORIZED SERVICE PROVIDERS BE LIABLE FOR ANY ACCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF DATA, LOSS OF BUSINESS OR PROFITS.

General

The customer may not assign this certificate without OPTIMUM Computer's prior written consent. All notices hereunder shall be in writing addressed to the parties at their respective addresses set forth on the invoice. This Certificate is the complete agreement between the parties with respect to its subject matter and supersedes all prior or contemporaneous agreements, promises and proposals, whether oral or written, between the parties. No terms or conditions hereof shall be deemed waived and no breach or default excused unless such waiver or excuse shall be in writing and signed by the party to be charged. In the event that one or more provisions contained in this Agreement should be held to be unenforceable, its unenforceability shall not affect any other provisions of the Agreement. OPTIMUM has the right to cancel this contract any time with a write notification and pay to the customer the difference for the period not used.
